Accrued Vacation and Bonus Pay May Be Deemed Unpaid Wages

Under Florida’s Labor Code and depending on other circumstances, accrued but unused vacation and bonus pay may be deemed “unpaid wages” and a court may award court costs and attorneys’ fees to a former employee who wins a lawsuit for unpaid wages. Further, an employer’s failure to pay final wages promptly by the next regular pay date may be deemed a violation of the FLSA.
