The EEOC recently determined that LGBT employees are protected from discrimination under Title VII. This is a major shift from prior determinations of the EEOC. The EEOC limited this new interpretation to federal workers. However, the ruling may result in similar rulings by courts as they consider private sector claims. Courts have traditionally ruled that Title VII does not cover LGBT discrimination claims. This new EEOC ruling will provide compelling new persuasive authority to support the claims of LGBT workers and possibly result in courts reconsidering unfavorable precedent whether LGBT status is protected under Title VII. It is now more important than ever for businesses to reevaluate their personnel policies regarding all forms of discrimination, especially among LGBT workers, to avoid costly lawsuits.
